Wills (Last, Testamentary and Living)

Last and Testamentary Wills

A Last and Testament Will is a legal document that explains when and how your beneficiaries will inherit your property and assets. This document should also list the executor, also known as the personal representative. The executor will be the person given responsibility in settling any final affairs and will also guide your estate through the probate process.

Living

A living will is a legal document written in the context of end of life medical treatment. This document will describe your personal choices in regards to medical treatment. An example of when this is useful is in the instance of you becoming unconscious or in a terminal state, therefore not making decisions on your behalf. In summary, a living will is different from a last will and testament because it does not describe what happens after you die, but rather while you are still living.
